para <strong><span class=\"has-inline-color has-vivid-red-color\">AUMENTAR <\/span><\/strong>la<strong> PENA<\/strong> CORRESPONDIENTE al <strong>DELITO MAYOR<\/strong> con la de los restantes<\/p>\n\n\n\n<p>A partir de una <strong>RESOLUCI\u00d3N<\/strong> de la Suprema Corte <strong><span class=\"has-inline-color has-vivid-red-color\">DESDE esta semana<\/span><\/strong> EST\u00c1 <strong><span class=\"has-inline-color has-vivid-red-color\">CONDICIONADA<\/span><\/strong> a la obligaci\u00f3n de <strong>FUNDAR <\/strong>y<strong> MOTIVAR<\/strong> esa decisi\u00f3n<\/p>\n\n\n\n<p>Exist\u00eda <strong><span class=\"has-inline-color has-vivid-red-color\">CONTRADICCI\u00d3N<\/span><\/strong> entre Tribunales para aumentar las penas en caso de concurso ideal de delitos<\/p>\n\n\n\n<ul><li><span class=\"has-inline-color has-vivid-red-color\"><strong>Unos<\/strong> <\/span>dec\u00edan que se pod\u00edan <strong>aumentar <\/strong>las penas <strong><span class=\"has-inline-color has-vivid-red-color\">\u00daNICAMENTE<\/span><\/strong> con la obligaci\u00f3n de <strong>JUSTIFICAR<\/strong> el <strong>monto <\/strong>del incremento<\/li><\/ul>\n\n\n\n<ul><li><strong><span class=\"has-inline-color has-vivid-red-color\">Otros<\/span><\/strong> dec\u00edan que <span class=\"has-inline-color has-vivid-red-color\"><strong>era<\/strong> obligaci\u00f3n<\/span> <strong>MOTIVAR<\/strong> la <strong>DECISI\u00d3N<\/strong> de <strong>incrementar<\/strong> las sanciones <strong>y NO S\u00d3LO<\/strong> la magnitud del aumento.<\/li><\/ul>\n\n\n\n<p>La Suprema Corte <span class=\"has-inline-color has-vivid-red-color\"><strong>conjunto <\/strong><\/span>el <strong>an\u00e1lisis<\/strong> del <strong>primer<\/strong> p\u00e1rrafo del art\u00edculo <strong>64<\/strong> del C\u00f3digo Penal Federal, y con el art\u00edculo <strong>16<\/strong> de la <strong>Constituci\u00f3n<\/strong><\/p>\n\n\n\n<p>Llegando a la determinaci\u00f3n de que <span class=\"has-inline-color has-vivid-red-color\">era <strong>NECESARIO<\/strong><\/span><strong>:<\/strong><\/p>\n\n\n\n<ul><li>Dar de <span class=\"has-inline-color has-vivid-red-color\"><strong>forma<\/strong> concreta<\/span> a las razones particulares,<\/li><li><span class=\"has-inline-color has-vivid-red-color\"><strong>Circunstancias<\/strong> especiales<\/span> o<\/li><li><span class=\"has-inline-color has-vivid-red-color\"><strong>Causas<\/strong> inmediatas<\/span> tomadas en cuenta para incrementar o no la sanci\u00f3n.<\/li><\/ul>\n\n\n\n<p>Porque si se <strong>opta por el incremento<\/strong> es necesario establecer bajo qu\u00e9 modalidad de la ley se hace<\/p>\n\n\n\n<p><strong>Ya que<\/strong>:<\/p>\n\n\n\n<ul><li>Si son <strong>SIMILARES<\/strong> el aumento podr\u00eda ser <span class=\"has-inline-color has-vivid-red-color\"><strong>HASTA<\/strong> por la <strong>MITAD<\/strong><\/span> del <strong>M\u00c1XIMO<\/strong> de la duraci\u00f3n de ellas<\/li><li><span class=\"has-inline-color has-vivid-red-color\">Si no<\/span>, existir\u00e1 la <strong>posibilidad <\/strong>de <strong>imponer<\/strong> <strong>ALGUNAS<\/strong>, o bien, <strong>TODAS<\/strong>.<\/li><\/ul>\n\n\n\n<p>Por lo que se <strong>deber\u00e1 MOTIVAR<\/strong> el <span class=\"has-inline-color has-vivid-red-color\"><strong>qu\u00e1ntum <\/strong><\/span>del incremento de la pena restrictiva de la libertad personal, del principio <strong>nulla poena sine necessitate<\/strong>, conforme al cual s\u00f3lo resulta viable la <strong><span class=\"has-inline-color has-vivid-red-color\">IMPOSICI\u00d3N<\/span> de la PRISI\u00d3N<\/strong> por el tiempo estrictamente indispensable para cumplir su prop\u00f3sito<\/p>\n\n\n\n<p>Ya que <strong>CUANDO<\/strong> la ley <strong><span class=\"has-inline-color has-vivid-red-color\">otorga<\/span> a la autoridad<\/strong> un amplio campo de apreciaci\u00f3n <strong>para actuar <\/strong>o<strong> no<\/strong> de determinada manera <strong>FACULT\u00c1NDOLA<\/strong> para disponer libremente el contenido de su proceder, <strong>TIENE<\/strong> la <strong><span class=\"has-inline-color has-vivid-red-color\">INSOSLAYABLE OBLIGACI\u00d3N<\/span><\/strong> de <strong>fundar <\/strong>y<strong> motivar<\/strong> su decisi\u00f3n.<\/p>\n\n\n\n<p>Esta es una determinaci\u00f3n <span class=\"has-inline-color has-vivid-red-color\">aplicable <strong>DESDE <\/strong>esta<strong> SEMANA<\/strong> en todo el Pa\u00eds<\/span>.<\/p>\n\n\n\n<p>La informaci\u00f3n
