V, de la Ley del Seguro Social<\/u><\/em>, <\/mark><mark style=\"background-color:#fae1e7\" class=\"has-inline-color\"><strong>\u00fanicamente<\/strong> cuando se <strong>pagan<\/strong> en <strong>especie,<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> o <\/mark><mark style=\"background-color:#b5d3ed\" class=\"has-inline-color\"><strong>tambi\u00e9n cuando se pagan en efectivo<\/strong><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#31049e\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s de la Segunda Sala <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#890505\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que las prestaciones las <mark style=\"background-color:rgba(0, 0, 0, 0);color:#aa4802\" class=\"has-inline-color\"><strong><u>prestaciones<\/u><\/strong> de <strong>habitaci\u00f3n y alimentaci\u00f3n<\/strong><\/mark> <strong><mark style=\"background-color:#fcfa00\" class=\"has-inline-color has-black-color\">S\u00d3LO<\/mark><\/strong> pueden <mark style=\"background-color:#f2a5ca\" class=\"has-inline-color\"><strong>excluirse<\/strong> del <strong>salario<\/strong> base de cotizaci\u00f3n <strong>si se entregan en ESPECIE.<\/strong><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#2207e3\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que <mark style=\"background-color:rgba(0, 0, 0, 0);color:#06754c\" class=\"has-inline-color\"><strong>Excluir<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> los conceptos de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#06754c\" class=\"has-inline-color\"> <strong>habitaci\u00f3n y alimentaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#06754c\" class=\"has-inline-color\"><strong>salario base<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de cotizaci\u00f3n <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#06754c\" class=\"has-inline-color\"><strong>beneficia<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a los<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#06754c\" class=\"has-inline-color\"> <strong>PATRONES<\/strong>, ya que <strong>realizan gestiones para proporcionar inmuebles y alimentos<\/strong><\/mark> a los Trabajadoras, seg\u00fan el art\u00edculo 27, fracci\u00f3n V, de la Ley del Seguro Social. <\/p>\n\n\n\n<p>Y <mark style=\"background-color:rgba(0, 0, 0, 0);color:#a60638\" class=\"has-inline-color\"><strong>permitir<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> que estas prestaciones se<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a60638\" class=\"has-inline-color\"><strong> entreguen en efectivo <em>desvirtuar\u00eda la excepci\u00f3n<\/em><\/strong><\/mark><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">, ya que<\/mark><\/em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a60638\" class=\"has-inline-color\"> <strong>no se podr\u00eda comprobar su destino, afectando <\/strong>el <strong>pago <\/strong>de<strong> cuotas obrero-patronales<\/strong> <\/mark>y perjudicando el derecho a la seguridad social de los trabajadores.
