<strong>ANTECEDENTE<\/strong><\/p>\n\n\n\n<p><strong>Surge <\/strong>luego de que una familia <strong>desplazada<\/strong> forzosamente <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#eb6403\" class=\"has-inline-color\">promovi\u00f3 un amparo<\/mark><\/strong> indirecto <strong>contra<\/strong> la <em><u><mark style=\"background-color:rgba(0, 0, 0, 0);color:#3d0373\" class=\"has-inline-color\">Comisi\u00f3n Ejecutiva de Atenci\u00f3n a V\u00edctimas<\/mark><\/u><\/em> por <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d35d08\" class=\"has-inline-color\">NO dictar medidas de reparaci\u00f3n integral<\/mark><\/strong>, especialmente la<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#d85c03\" class=\"has-inline-color\">compensaci\u00f3n<\/mark>, <\/strong>y por la<mark style=\"background-color:rgba(0, 0, 0, 0);color:#e71313\" class=\"has-inline-color\"><strong> inconstitucionalidad del art\u00edculo 144<\/strong> <\/mark>de la <em><u>Ley General de V\u00edctimas<\/u><\/em>, el cual <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d80a0a\" class=\"has-inline-color\">exige un escrito de solicitud para acceder a los recursos<\/mark><\/strong>. <\/p>\n\n\n\n<p>El Juez sobresey\u00f3 el caso por falta de dicho escrito, y la familia interpuso un recurso de revisi\u00f3n contra esta decisi\u00f3n.<\/p>\n\n\n\n<p><strong>.<\/strong><\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#300281\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark><\/strong> a trav\u00e9s de la Primera Sala, <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#900303\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark><\/strong> que el <em><strong>art\u00edculo en menci\u00f3n<\/strong><\/em> es <mark style=\"background-color:rgba(0, 0, 0, 0);color:#01905b\" class=\"has-inline-color\"><strong>LEGAL<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> y por tanto se<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#01905b\" class=\"has-inline-color\"> <strong>DEBE Realizar y PRESENTAR el Escrito de SOLICITUD <\/strong><\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">para<\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#01905b\" class=\"has-inline-color\"><strong> ACCEDER <\/strong><\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a los <\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#01905b\" class=\"has-inline-color\"><strong>RECURSOS <\/strong><\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de<\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#01905b\" class=\"has-inline-color\"><strong> COMPENSACI\u00d3N.<\/strong><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la<mark style=\"background-color:rgba(0, 0, 0, 0);color:#01077b\" class=\"has-inline-color\"> <strong>SCJN<\/strong><\/mark> es que la <mark style=\"background-color:#f1ce6e\" class=\"has-inline-color\"><strong>exigencia <\/strong>de <strong>presentar escritos de solicitud<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> asegura la <\/mark><mark style=\"background-color:#f1ce6e\" class=\"has-inline-color\"><strong>transparencia<\/strong> <\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">en los <\/mark><mark style=\"background-color:#f1ce6e\" class=\"has-inline-color\"><strong>procedimientos<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> y previene la discrecionalidad de las autoridades para <\/mark><mark style=\"background-color:#f1ce6e\" class=\"has-inline-color\"><strong>decidir<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"><strong> <\/strong><em><u>cu\u00e1ndo cuantificar<\/u><\/em> la <\/mark><mark style=\"background-color:#f1ce6e\" class=\"has-inline-color\"><strong>compensaci\u00f3n<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> de OFICIO y cu\u00e1ndo hacerlo a <\/mark><mark style=\"background-color:#f1ce6e\" class=\"has-inline-color\"><strong>petici\u00f3n de parte.<\/strong><\/mark><\/p>\n\n\n\n<p>As\u00ed que, la <em><u>presentaci\u00f3n de escritos<\/u><\/em> <mark style=\"background-color:#f6c4d0\" class=\"has-inline-color\"><strong>no es una carga desproporcionada<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">, ya que los <\/mark><mark style=\"background-color:#f6c4d0\" class=\"has-inline-color\"><strong>requisitos<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> <em><u>establecidos<\/u><\/em> <\/mark><mark style=\"background-color:#f6c4d0\" class=\"has-inline-color\"><strong>no violan los derechos<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> <em><u>p\u00fablicos subjetivos de las personas y tienen una justificaci\u00f3n<\/u><\/em>. La <em>Ley General de V\u00edctima<\/em>s <\/mark><mark style=\"background-color:#f6c4d0\" class=\"has-inline-color\"><strong>permite a las v\u00edctimas acceder a asesor\u00eda jur\u00eddica federal para facilitar el acceso a los mecanismos de reparaci\u00f3n integral<\/strong>.<\/mark><\/p>\n\n\n\n<p><strong>.<\/strong><\/p>\n\n\n\n<p>Sin embargo, las&nbsp;<mark style=\"background-color:#baf4dd\" class=\"has-inline-color\"><strong>autoridades<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">&nbsp;deben cumplir con su&nbsp;<\/mark><mark style=\"background-color:#baf4dd\" class=\"has-inline-color\"><strong>obligaci\u00f3n<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">&nbsp;de garantizar el&nbsp;<\/mark><mark style=\"background-color:#baf4dd\" class=\"has-inline-color\"><strong>acceso efectivo<\/strong><\/mark><mark class=\"has-inline-color\"><strong>requisito<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">&nbsp;de presentar&nbsp;<\/mark><mark
