la licencia de uso de suelo requerida, lo que llev\u00f3 a la <em><u>rescisi\u00f3n del contrato<\/u><\/em> y al <strong>pago<\/strong> de una <strong>pena convencional <\/strong><em><u>equivalente a los meses de renta restantes, que en este caso eran cinco a\u00f1os.<\/u><\/em><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#220599\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal de Circuito<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#9f0505\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark><\/strong> que, <mark style=\"background-color:#cdf393\" class=\"has-inline-color\"><strong>NO <\/strong>hay <strong>usura<\/strong> ni explotaci\u00f3n <em><u>si la pena convencional en un contrato de arrendamiento<\/u><\/em> <strong>no excede la obligaci\u00f3n principal<\/strong><\/mark>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#280196\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, <mark style=\"background-color:rgba(0, 0, 0, 0);color:#990647\" class=\"has-inline-color\"><strong>No se actualiza la explotaci\u00f3n del hombre por el hombre ni la usura<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en <em><u>contratos de arrendamiento entre personas morales<\/u><\/em>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#990647\" class=\"has-inline-color\">&nbsp;<strong>Una parte es comerciante y la otra es una inmobiliaria<\/strong>, <em>especialista en su ramo, que <strong>conoce las cl\u00e1usulas del contrato<\/strong><\/em>.<\/mark>&nbsp;<\/p>\n\n\n\n<p>Por tanto, la<strong> <\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#aa067b\" class=\"has-inline-color\"><strong>pena convencional NO viola derechos humanos<\/strong>&nbsp;<strong>si no excede la obligaci\u00f3n principal<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Por lo que la SCJN establece que la <em><u>usura ocurre con intereses excesivos derivados de un pr\u00e9stamo<\/u><\/em>, y la explotaci\u00f3n implica<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#aa067b\" class=\"has-inline-color\">&nbsp;<strong>desigualdad y afectaci\u00f3n a la dignidad<\/strong>.&nbsp;<strong>Una operaci\u00f3n ventajosa no es explotaci\u00f3n<\/strong><\/mark>&nbsp;a menos que afecte la dignidad de las personas.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Esta <strong><mark style=\"background-color:#f78f45\" class=\"has-inline-color\">RESOLUCI\u00d3N<\/mark> <\/strong>esta <strong>disponible <\/strong>para quien la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b0101\"
