autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>.<\/p>\n\n\n\n<p>El <strong>ANTECEDENTE <\/strong>surge<strong>:<\/strong><\/p>\n\n\n\n<p>Despu\u00e9s de que los <strong>tribunales <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">electorales<\/mark><\/strong> tuvieron <strong>criterios <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">diferentes<\/mark><\/strong> respecto a c\u00f3mo debe entenderse el requisito de <strong>tener<\/strong> un <strong>&#8220;modo honesto de vivir&#8221;<\/strong> para ocupar un <strong>cargo p\u00fablico<\/strong>.<\/p>\n\n\n\n<p>Se se\u00f1al\u00f3 que este <strong>requisito <\/strong>es <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">ambiguo<\/mark><\/strong>, de <strong>dif\u00edcil <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">apreciaci\u00f3n<\/mark><\/strong> y <strong>altamente <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">subjetivo<\/mark><\/strong>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Ante esto La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#0709e3\" class=\"has-inline-color\">Suprema Corte de Justica<\/mark>,<mark style=\"background-color:rgba(0, 0, 0, 0);color:#9b0707\" class=\"has-inline-color\"> DETERMIN\u00d3<\/mark> <\/strong>que es <strong><mark style=\"background-color:#add6ef\" class=\"has-inline-color\">INV\u00c1LIDO<\/mark><\/strong> <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">exigir<\/mark><\/strong> a las personas <strong><em>demostrar<\/em><\/strong> que <strong><mark style=\"background-color:#fcb900\" class=\"has-inline-color has-black-color\">viven honestamente<\/mark><\/strong> para as\u00ed <strong>poder ocupar un cargo p\u00fablico<\/strong> de cualquier \u00edndole. <\/p>\n\n\n\n<p>De igual manera, <strong>tampoco <\/strong>los <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">jueces <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">o<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"> tribunales<\/mark><\/strong> <strong><mark style=\"background-color:#fcb900\" class=\"has-inline-color\">pueden solicitarlo<\/mark><\/strong> y para que en base a su apreciaci\u00f3n se le pueda <strong>negar<\/strong> su derecho a tener un cargo p\u00fablico o una postulaci\u00f3n electoral.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1407e3\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es basada en la expresi\u00f3n &#8220;<strong><mark style=\"background-color:#ff6900\" class=\"has-inline-color\">modo honesto de vivir<\/mark><\/strong>&#8221; ya que esta es <strong>ambigua<\/strong>, porque <strong>puede entenderse de <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">varios modos<\/mark><\/strong>, admitir <strong>distintas<\/strong> <strong>interpretaciones<\/strong> y dar, por consiguiente, <strong>motivo a <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">dudas, incertidumbre<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> o<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"> confusi\u00f3n<\/mark><\/strong> en cuanto a su contenido y alcance. <\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Al ser <strong>tan<\/strong> abierta, posibilita la <strong>incorporaci\u00f3n<\/strong> de <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">prejuicios <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">o<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"> valoraciones<\/mark> personales<\/strong> como criterio para el acceso a un cargo p\u00fablico. <\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La valoraci\u00f3n del citado requisito es <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">subjetiva<\/mark><\/strong>, ya que su significaci\u00f3n depender\u00e1 de lo que cada persona <strong>opine, practique <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">o<\/mark> quiera<\/strong> entender respecto a los componentes que distinguen a la <strong>\u00e9tica <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">personal<\/mark><\/strong>. <\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Su aplicaci\u00f3n puede <strong>generar <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">discriminaci\u00f3n<\/mark><\/strong>, pues la evaluaci\u00f3n del requisito queda subordinada al <strong>juicio <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">valorativo<\/mark> y <\/strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>discrecional<\/strong> <\/mark>de quienes lo aplican, esto es, a lo que los aplicadores de la norma conciban como un sistema de vida honesto. <\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p><strong>Adem\u00e1s<\/strong>, un r\u00e9gimen constitucional democr\u00e1tico de Derecho <strong>debe <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">rechazar<\/mark> <\/strong>la idea de un modelo <strong>\u00fanico<\/strong> de <strong>moralidad<\/strong> que reduzca la idea de honestidad o decencia a una sola dimensi\u00f3n y, <strong>en cambio<\/strong>, acoger la <strong>diversidad de <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">opiniones, creencias<\/mark> y <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">proyectos<\/mark> de vida<\/strong>. <\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Por ello, <strong>tampoco<\/strong> es v\u00e1lido que se <strong>vincule <\/strong>a los <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">jueces del pa\u00eds<\/mark><\/strong>, <strong>federales <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">o<\/mark> locales<\/strong>, a <strong>evaluar <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">oficiosamente<\/mark><\/strong> si una persona <strong><mark style=\"background-color:#fcb900\" class=\"has-inline-color\">perdi\u00f3 o no<\/mark><\/strong> su &#8220;modo honesto de vida&#8221;
