class=\"has-text-align-justify\">Surge luego de que el <strong>Ministerio P\u00fablico<\/strong>, <strong><mark style=\"background-color:#ff6900\" class=\"has-inline-color\">decret\u00f3 el aseguramiento de un veh\u00edculo relacionado con un hecho con apariencia de delito<\/mark><\/strong>, de una persona <strong>ajena<\/strong> a la <strong>carpeta de investigaci\u00f3n<\/strong>, esto <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Sin previa orden Judicial y sin especificar el tiempo durante la cual permanecer\u00e1 el auto sujeto al aseguramiento<\/mark><\/strong>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#140891\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s de su Tribunal Colegiado de Circuito <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bf0f0f\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark><\/strong> que se <strong><mark style=\"background-color:#bdd3e6\" class=\"has-inline-color\">REQUIERE una Orden Judicial<\/mark><\/strong> previa, para que el Ministerio P\u00fablico pueda <strong><mark style=\"background-color:#a7c8e5\" class=\"has-inline-color\">asegurar un veh\u00edculo<\/mark><\/strong>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p class=\"has-text-align-justify\">La justificaci\u00f3n de la <mark style=\"background-color:rgba(0, 0, 0, 0);color:#0f0bae\" class=\"has-inline-color\">SCJN<\/mark> es que conforme al <span style=\"text-decoration: underline;\"><em>art\u00edculo 252 del C\u00f3digo Nacional de Procedimientos Penales,<\/em><\/span> se <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\">requieren autorizaci\u00f3n previa del Juez de Control<\/mark> <\/strong>en todos los actos de investigaci\u00f3n que impliquen afectaci\u00f3n a derechos establecidos en la Constituci\u00f3n y, en el <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">aseguramiento de veh\u00edculo<\/mark><\/strong>, el cual es de car\u00e1cter temporal y provisional, es un <mark style=\"background-color:#d4fc8d\" class=\"has-inline-color\"><strong>acto de molestia<\/strong> que puede <strong>da\u00f1ar los derechos de propiedad y posesi\u00f3n<\/strong><\/mark>, esto <strong>al restringir <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">temporalmente<\/mark><\/strong> la <strong>libre disposici\u00f3n de ese bien<\/strong>, aunado a que <strong>esa t\u00e9cnica de investigaci\u00f3n<\/strong> <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">no se encuentra dentro de las hip\u00f3tesis relativas a los actos de investigaci\u00f3n exentos de dicho control judicial<\/mark><\/strong>, establecidas en el art\u00edculo 252 del mismo ordenamiento.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Esta <strong><mark style=\"background-color:#f2a4b8\" class=\"has-inline-color\">RESOLUCI\u00d3N<\/mark> <\/strong>esta <strong>disponible<\/strong> para quien la haga valer a partir de esta semana.<\/p>\n\n\n\n<p class=\"has-small-font-size\"><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">Tesis Penal<\/mark><mark style=\"background-color:rgba(0, 0, 0,
