Sin embargo, esta<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#100391\" class=\"has-inline-color\"> <strong>solicitud no fue aceptada<\/strong>.<\/mark><\/p>\n\n\n\n<p>Ante esto el abogado <mark style=\"background-color:#f6bcca\" class=\"has-inline-color\"><strong>promovi\u00f3 un amparo<\/strong> <\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">indirecto, pero tambi\u00e9n le fue <\/mark><mark style=\"background-color:#f6bcca\" class=\"has-inline-color\"><strong>negado<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> debido a que <\/mark><mark style=\"background-color:#f6bcca\" class=\"has-inline-color\"><strong>no ten\u00eda legitimaci\u00f3n para solicitar medidas cautelares a su favor<\/strong><\/mark>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#120692\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal Colegiado <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#990404\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark><\/strong> que, el <mark style=\"background-color:#90f642\" class=\"has-inline-color\"><strong>abogado autorizado<\/strong> <\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">en t\u00e9rminos amplios <\/mark><mark style=\"background-color:#90f642\" class=\"has-inline-color\"><strong>NO tiene legitimaci\u00f3n para solicitar medidas cautelares<\/strong> <strong>a su favor<\/strong><\/mark> en un juicio de divorcio incausado.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#080091\" class=\"has-inline-color\">SCJN<\/mark> <\/strong>es que, el art\u00edculo 941 del C\u00f3digo de Procedimientos Civiles en este caso para la CdMx., <mark style=\"background-color:#f8d062\" class=\"has-inline-color\"><strong>permite<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> a la <em><u>autoridad judicial<\/u><\/em> <\/mark><mark style=\"background-color:#f8d062\" class=\"has-inline-color\"><strong>intervenir en asuntos familiares de oficio<\/strong>.
