{"id":32068,"date":"2025-05-21T00:19:00","date_gmt":"2025-05-21T06:19:00","guid":{"rendered":"https:\/\/www.salgadonoticias.com\/?p=32068"},"modified":"2025-05-21T17:50:43","modified_gmt":"2025-05-21T23:50:43","slug":"32068","status":"publish","type":"post","link":"https:\/\/www.salgadonoticias.com\/?p=32068","title":{"rendered":"EMPLAZAMIENTO en Juicio ORAL Mercantil es Responsabilidad del JUZGADO\u2026!!!"},"content":{"rendered":"<p>Views: 18<\/p>\n<p>.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-video is-provider-youtube wp-block-embed-youtube wp-embed-aspect-16-9 wp-has-aspect-ratio\"><div class=\"wp-block-embed__wrapper\">\n<iframe loading=\"lazy\" title=\"Mi\u00e9rcoles 21 de mayo 2025 esto lo relevante\" width=\"640\" height=\"360\" src=\"https:\/\/www.youtube.com\/embed\/PHIHpoQteWw?feature=oembed\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Este <strong>ANTEDECENTE<\/strong><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b74e04\" class=\"has-inline-color\"><strong>Surge<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><strong> <\/strong>luego de que, en un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b74e04\" class=\"has-inline-color\"><strong> juicio<\/strong> oral <strong>mercanti<\/strong>l, la <em><u>autoridad responsable decret\u00f3 la caducidad de la instancia<\/u><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Debido a que <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b74e04\" class=\"has-inline-color\"><strong>transcurrieron 120<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">d\u00edas h\u00e1biles<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b74e04\" class=\"has-inline-color\"> <em><u>sin que la parte actora<\/u><\/em> <strong>agendara una cita con el actuario<\/strong> j<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">udicial adscrito al juzgado para<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b74e04\" class=\"has-inline-color\"> <strong>llevar a cabo el emplazamiento<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#2a07e3\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal Colegiado<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#920101\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, en juicios orales mercantiles es <mark style=\"background-color:#d1b3ec\" class=\"has-inline-color has-black-color\"><strong>RESPONSABILIDAD <\/strong>del <strong>JUZGAGO <\/strong><em><u>programar y realizar<\/u><\/em> el <strong>EMPLAZAMIENTO<\/strong>, por lo que la <em><u>parte ACTORA<\/u><\/em> <strong>NO est\u00e1 obligada<\/strong> a <strong>agendar una cita<\/strong> con el actuario para realizarlo<\/mark>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#060376\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, la diligencia de <mark style=\"background-color:rgba(0, 0, 0, 0);color:#038409\" class=\"has-inline-color\"><strong>emplazamiento <\/strong>en el juicio oral mercantil <strong><em><u>debe realizarse sin esperar a que el actor agende una cita con el actuario judicial<\/u><\/em><\/strong>. Esto porque seg\u00fan el C\u00f3digo de Comercio y la Ley Org\u00e1nica del Poder Judicial de la CdMx, el <em><u>actuario judicial tiene obligaciones que no pueden ser ignoradas<\/u><\/em>.<\/mark><\/p>\n\n\n\n<p>Conforme al art. 1068 del C\u00f3digo se\u00f1alado se <mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\"><strong>establece<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que las<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\"> <em><u>notificaciones personales<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">DEBEN<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\"> <em><u>realizarse dentro de los tres d\u00edas siguientes a la recepci\u00f3n del expediente por parte del notificador<\/u><\/em>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Es<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\"> <strong>obligaci\u00f3n del Juzgado<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">recibir el expediente, registrarlo en el libro autorizado<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\">, <strong>practicar la notificaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en el plazo de tres d\u00edas y devolver el expediente<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\">, <strong>sin necesidad de agendar citas previas con los litigantes<\/strong>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> La pr\u00e1ctica de <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\"><strong>exigir una cita<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">previa para el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#188004\" class=\"has-inline-color\"><strong> emplazamiento<\/strong> <strong>viola el derecho de acceso a la
