has-black-color\">una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"> <strong>indemnizaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">por la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"><em><u>p\u00e9rdida total de su veh\u00edculo debido a un robo<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> y su recuperaci\u00f3n, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"><em><u>basada en una cl\u00e1usula del seguro<\/u><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\">El JUEZ <strong>rechaz\u00f3<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">la <em><u>demanda<\/u><\/em> debido a que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">la ASEGURADA <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"><strong>NO notific\u00f3<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">formalmente a la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"> <strong>Aseguradora<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">sobre la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8b3d05\" class=\"has-inline-color\"> <em><u>liberaci\u00f3n del veh\u00edculo ni lo puso a disposici\u00f3n para su evaluaci\u00f3n o reparaci\u00f3n<\/u><\/em>.<\/mark><\/p>\n\n\n\n<p>. <\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#12018b\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal Colegiado<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c0808\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, si las <mark style=\"background-color:#bef389\" class=\"has-inline-color\"><strong>cl\u00e1usulas<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> del contrato de seguro de veh\u00edculo son <\/mark><mark style=\"background-color:#bef389\" class=\"has-inline-color\"><strong>AMBIGUAS<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> respecto a qui\u00e9n DEBE<\/mark><mark style=\"background-color:#bef389\" class=\"has-inline-color\"> <strong>dar el aviso formal<\/strong> <\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">de la liberaci\u00f3n del veh\u00edculo y llevarlo al taller para su evaluaci\u00f3n o reparaci\u00f3n, es la <\/mark><mark style=\"background-color:#bef389\" class=\"has-inline-color\"><strong>ASEGURADORA<\/strong> quien tiene la <strong>OBLIGACI\u00d3N de probar estas circunstancias<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la<mark style=\"background-color:rgba(0, 0, 0, 0);color:#1d0696\" class=\"has-inline-color\"> <strong>SCJN<\/strong> <\/mark>es que la <strong><em>Ley sobre el Contrato de Seguro<\/em><\/strong>&nbsp;<mark style=\"background-color:#facf57\" class=\"has-inline-color\"><strong>NO permite<\/strong> la&nbsp;<strong>supletoriedad<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">&nbsp;expresa de otro ordenamiento. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">Sin embargo, a\u00fan cuando el&nbsp;<\/mark><strong><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">C\u00f3digo de Comercio&nbsp;<\/mark><\/strong><mark style=\"background-color:#facf57\" class=\"has-inline-color\">permite la supletoriedad y regula la&nbsp;<strong>autonom\u00eda de la voluntad<\/strong>.<\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> Los art\u00edculos&nbsp;1851 a 1859 del C\u00f3digo Civil Federal&nbsp;<\/mark><mark style=\"background-color:#facf57\" class=\"has-inline-color\"><strong>establecen<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> que las <\/mark><mark style=\"background-color:#facf57\" class=\"has-inline-color\"><strong>cl\u00e1usulas del contrato deben ser claras<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color has-black-color\"> sobre los&nbsp;<\/mark><mark style=\"background-color:#facf57\" class=\"has-inline-color\"><strong>derechos y obligaciones<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">&nbsp;de los&nbsp;<\/mark><mark style=\"background-color:#facf57\" class=\"has-inline-color\"><strong>contratantes<\/strong>.<\/mark><mark
