autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Este <strong>ANTEDECENTE<\/strong><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"><strong>Surge<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><strong> <\/strong>luego de que, en un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"> <strong>juicio laboral<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el <em><u>J<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"><em><u>UEZ orden\u00f3 enviar el expediente al Centro de Conciliaci\u00f3n<\/u><\/em> para <strong>agotar la fase de conciliaci\u00f3n prejudicial<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Debido a que consider\u00f3<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"> <em><u>ineficaces las constancias de no conciliaci\u00f3n presentadas por el demandante<\/u><\/em>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ya que se mencionaba que el objeto de la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"><strong>conciliaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">era el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"><strong>&#8220;pago de prestaciones&#8221;<\/strong> y la <strong>&#8220;rescisi\u00f3n de la relaci\u00f3n de trabajo&#8221;.<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Pero, seg\u00fan el juez, esto<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#49038a\" class=\"has-inline-color\"> <strong>no cumpl\u00eda<\/strong> <\/mark>con lo<strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#470584\" class=\"has-inline-color\"> requerido<\/mark><\/strong> por el art\u00edculo 684-B de la Ley del Trabajo, porque la <em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4b078a\" class=\"has-inline-color\">acci\u00f3n ejercida era de indemnizaci\u00f3n constitucional.<\/mark><\/em><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#0709e3\" class=\"has-inline-color\">Suprema Corte de Justicia <\/mark><\/strong>a trav\u00e9s del Tribunal Colegiado<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#9f0606\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, una <strong><mark style=\"background-color:#d9db7b\" class=\"has-inline-color\">discrepancia<\/mark><\/strong> entre el &#8220;objeto&#8221; indicado en la constancia de no conciliaci\u00f3n y la acci\u00f3n ejercida <mark style=\"background-color:#aef3e0\" class=\"has-inline-color\"><strong>NO es suficiente <\/strong>para<strong> CONCLUIR <\/strong>que no se <strong>agot\u00f3 la etapa de conciliaci\u00f3n prejudicial<\/strong> <\/mark>seg\u00fan el art\u00edculo 684-B.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#070494\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, los art\u00edculos&nbsp;<mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\"><strong>684-C<\/strong>&nbsp;y&nbsp;<strong>684-E<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la Ley Federal del Trabajo <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\"><em><u>indican que el requisito<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\">&nbsp;<strong>&#8220;objeto de la cita a la contraparte&#8221;<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">APLICA para la <em><u>solicitud de conciliaci\u00f3n<\/u><\/em>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\"> <strong>NO para la constancia de no conciliaci\u00f3n<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">La informaci\u00f3n aportada por las partes, como el objeto de la cita, no puede comunicarse a terceros. El<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\">&nbsp;<strong>Centro de Conciliaci\u00f3n<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">debe<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\"> <strong>EXPEDIR<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\"><em><u>constancia de no conciliaci\u00f3n o el convenio de conciliaci\u00f3n y remitir los documentos al tribunal<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">correspondiente. La<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#bb5208\" class=\"has-inline-color\">&nbsp;<strong>SCJN<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">&nbsp;determin\u00f3 que la constancia de no conciliaci\u00f3n verifica que se activ\u00f3 y no prosper\u00f3 la etapa conciliatoria prejudicial.
