carpeta de investigaci\u00f3n. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Ante la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#cf5a06\" class=\"has-inline-color\"> <em><u>falta de respuesta<\/u><\/em>, <strong>pidi\u00f3<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#cf5a06\" class=\"has-inline-color\"><strong>control judicial<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">seg\u00fan el art\u00edculo 258 del C\u00f3digo Nacional de Procedimientos Penales. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">El<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#cf5a06\" class=\"has-inline-color\"> <strong>Juez<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de Control<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#cf5a06\" class=\"has-inline-color\">, <strong>sin abrir debate<\/strong>, <em><u>resolvi\u00f3 que <strong>NO<\/strong> proced\u00eda la <strong>devoluci\u00f3n<\/strong> del veh\u00edculo<\/u><\/em><\/mark><em><u>.<\/u><\/em><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#2c07a9\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal Colegiado de Circuito<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#910303\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, cuando el <mark style=\"background-color:rgba(0, 0, 0, 0);color:#450283\" class=\"has-inline-color\"><strong>Juez<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de Control<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#450283\" class=\"has-inline-color\"> <em><u>celebra la audiencia de control judicial<\/u><\/em> <strong>sin abrir debate<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">entre las partes y <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#450283\" class=\"has-inline-color\"><strong>resuelve<\/strong> <em><u>solo con lo expuesto por el solicitante<\/u><\/em>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#450283\" class=\"has-inline-color\"> <strong>viola<\/strong> el <em><u>principio de contradicci\u00f3n<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del art\u00edculo 20 de la Constituci\u00f3n y las<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#450283\" class=\"has-inline-color\"> <strong>formalidades<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#450283\" class=\"has-inline-color\"> <em><u>juicio oral acusatorio<\/u><\/em> <\/mark>seg\u00fan el C\u00f3digo Nacional de Procedimientos Penales.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#210499\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, su&nbsp;<mark style=\"background-color:rgba(0, 0, 0, 0);color:#079561\" class=\"has-inline-color\"><strong><em><u>Primera Sala<\/u><\/em>,<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">al resolver la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#079561\" class=\"has-inline-color\">&nbsp;<strong>contradicci\u00f3n de tesis 252\/2018<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">CONCLUY\u00d3 que el&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#079561\" class=\"has-inline-color\"><strong>art\u00edculo 258 del C\u00f3digo en menci\u00f3n<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">&nbsp;<em><u>DEBE interpretarse seg\u00fan los principios constitucionales<\/u><\/em> del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#079561\" class=\"has-inline-color\">&nbsp;<strong>sistema penal acusatorio<\/strong>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> especialmente los de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#079561\" class=\"has-inline-color\">&nbsp;<strong>publicidad<\/strong>,&nbsp;<strong>oralidad<\/strong>&nbsp;y&nbsp;<strong>contradicci\u00f3n<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">conforme al&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#079561\" class=\"has-inline-color\"><strong>art. 20, apartado A, fracc.
