style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">despu\u00e9s de que, en un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"> <em><u>juicio especial hipotecario<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en la CdMx., la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"> <strong>parte demandada<\/strong> <em><u>argument\u00f3 que el juez competente deb\u00eda ser uno de Puebla<\/u><\/em>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">debido a la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"> <strong>excepci\u00f3n de incompetencia territorial<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">El <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"><em><u>tribunal<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de alzada<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"> <strong>acept\u00f3 esta excepci\u00f3n y remiti\u00f3 el caso a Puebla<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Pero el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"> <em><u>juzgado de Puebla<\/u><\/em> <strong>rechaz\u00f3<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">la competencia, esto porque el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#440580\" class=\"has-inline-color\"> <em><u>documento base de la acci\u00f3n<\/u><\/em> las partes <strong>hab\u00edan acordado someterse a los tribunales de la CdMx<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#200789\" class=\"has-inline-color\">Suprema Corte de Justici<\/mark>a <\/strong>a trav\u00e9s del Tribunal Colegiado de Circuito<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#8a0303\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, con una <mark style=\"background-color:#eec34c\" class=\"has-inline-color\"><strong>cl\u00e1usula de sumisi\u00f3n expresa<\/strong>, la <em><u>COMPETENCIA TERRITORIAL<\/u><\/em> se <strong>asignar\u00e1 al \u00f3rgano jurisdiccional acordado por las partes<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#340496\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, Si la&nbsp;<mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>acci\u00f3n hipotecaria<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">intentada deriva de una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>relaci\u00f3n de car\u00e1cter personal<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">entre las partes, en la cual acordaron una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>sumisi\u00f3n expresa<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a favor de los<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>\u00f3rganos jurisdiccionales<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del lugar en el cual se deb\u00eda cumplir la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>obligaci\u00f3n<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se actualiza el supuesto previsto en el&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>art\u00edculo 156<\/strong>, fracci\u00f3n II, del&nbsp;<strong>C\u00f3digo de Procedimientos Civiles<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">&nbsp;para el D.F., aplicable para la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>CdMx<\/strong>.<\/mark><\/p>\n\n\n\n<p>E<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">l correcto entendimiento de la primera parte del citado art\u00edculo y su fracc. III, relativa a que es<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>Juez competente<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el de la <em><u>ubicaci\u00f3n de la cosa si se ejercita una<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>acci\u00f3n real<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">&nbsp;sobre<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>bienes inmuebles<\/strong>, <\/mark><\/p>\n\n\n\n<p>Esto <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>DEBE entenderse <\/u><\/em><\/mark><em><u><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">s\u00f3lo<\/mark><\/strong><\/u><\/em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u> cuando no existe<\/u><\/em> una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>sumisi\u00f3n expresa<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">por parte de la demandada derivada de una&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>relaci\u00f3n personal<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">En t\u00e9rminos de los<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>art\u00edculos 149<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">primer p\u00e1rrafo,&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>151<\/strong>&nbsp;y&nbsp;<strong>152<\/strong>&nbsp;d<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el citado c\u00f3digo, la&nbsp;<strong>c<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>ompetencia por raz\u00f3n de territorio<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">puede <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><em><u>prorrogarse, siempre y cuando las partes litigantes se hubieren sometido<\/u><\/em><strong> expresamente<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">cuando hayan<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"> <strong>renunciado<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">claramente al&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>fuero<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que la ley les concede y se sujeten a la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>competencia<\/strong>&nbsp;del&nbsp;<strong>Juez<\/strong>&nbsp;al que se hayan <strong>sometido<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Por tanto, aun cuando del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"> <strong>acuerdo de voluntade<\/strong>s <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">entre las partes pudiera derivarse a la vez una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>acci\u00f3n de car\u00e1cter real<\/strong>, <\/mark>lo cierto es que tambi\u00e9n se sometieron<mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>expresamente<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\"><strong>competencia<\/strong>&nbsp;d<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">e los<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>tribunales<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del lugar del cumplimiento de la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#088154\" class=\"has-inline-color\">&nbsp;<strong>obligaci\u00f3n personal<\/strong>.<\/mark><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Esta <strong><mark style=\"background-color:#08fba2\"
