autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Este <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\">ANTEDECENTE<\/mark><\/strong><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"><strong>Surge <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">luego de que, un <em><u>hombre<\/u><\/em> fue<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"> <strong>sentenciado<\/strong> por <strong>tentativa de feminicidio<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y <em><u>promovi\u00f3<\/u><\/em> un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"> <strong>amparo<\/strong> <\/mark><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ALEGANDO <\/mark><\/em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"><em><strong>discriminaci\u00f3n hacia los hombres<\/strong><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">El Tribunal Colegiado<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"> <strong>neg\u00f3<\/strong><\/mark> la <em><u>protecci\u00f3n constitucional<\/u><\/em>, por lo que el hombre interpuso recurso de revisi\u00f3n.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1400a1\" class=\"has-inline-color\">Suprema Corte de Justicia <\/mark><\/strong>ante lo anterior <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b20808\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, el <em><u>tipo penal de feminicidio<\/u><\/em> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#6f0acd\" class=\"has-inline-color\"><strong>NO viola el derecho a la igualdad y no discriminaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la Constituci\u00f3n, debido a que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#6f0acd\" class=\"has-inline-color\"> <strong>PROMUEVE<\/strong> el <strong>DERECHO<\/strong> de las <strong>mujeres a vivir libres de violencia<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b1055d\" class=\"has-inline-color\"> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#b1055d\" class=\"has-inline-color\"><em><u>combate la discriminaci\u00f3n de g\u00e9nero<\/u><\/em>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#030ba8\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, para <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#017a4d\" class=\"has-inline-color\">RESOLVER<\/mark><\/strong> si un trato <mark style=\"background-color:rgba(0, 0, 0, 0);color:#027d50\" class=\"has-inline-color\"><em><u>diferenciado es justificado<\/u><\/em> o <em><u>discriminatorio se debe<\/u><\/em>:<\/mark><\/p>\n\n\n\n<ol>\n<li>V<mark style=\"background-color:#f9e1ac\" class=\"has-inline-color\">erificar su finalidad objetiva y v\u00e1lida;<\/mark><\/li>\n\n\n\n<li><mark style=\"background-color:#aeecd3\" class=\"has-inline-color\">Examinar la racionalidad de la medida; y<\/mark><\/li>\n\n\n\n<li><mark style=\"background-color:#fabfce\" class=\"has-inline-color\">Valorar la proporcionalidad para <strong>no afectar<\/strong> otros <strong>derechos constitucionales<\/strong>.<\/mark><\/li>\n<\/ol>\n\n\n\n<p>El <em><u>tipo penal de <strong>feminicidio<\/strong><\/u><\/em> <mark style=\"background-color:#c4f89d\" class=\"has-inline-color\"><strong>protege<\/strong> el derecho de las <strong>mujeres a vivir libres de violencia<\/strong> y combate la discriminaci\u00f3n de g\u00e9nero.<\/mark><\/p>\n\n\n\n<p>Y en esta medida se:<\/p>\n\n\n\n<ul>\n<li><mark style=\"background-color:rgba(0, 0, 0, 0);color:#e51404\" class=\"has-inline-color\">Equilibra los derechos ENTRE <strong>hombres y mujeres<\/strong> sin afectar otros derechos constitucionales<\/mark>;<\/li>\n\n\n\n<li><mark style=\"background-color:rgba(0, 0, 0, 0);color:#0681c9\" class=\"has-inline-color\">Se <strong>enfoca<\/strong> en la <em><u>vulnerabilidad de la v\u00edctima<\/u><\/em>, <strong>no<\/strong> en las caracter\u00edsticas del <strong>agresor<\/strong>;
