class=\"has-inline-color\"><strong>PAGAR<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> <em><u>Rentas Vencidas, Intereses Moratorios y una Pena Convencional<\/u><\/em> por la <\/mark><mark style=\"background-color:#8df1d2\" class=\"has-inline-color\"><strong>rescisi\u00f3n<\/strong><\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"><strong> <\/strong>de un <em><u>contrato de arrendamiento<\/u><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">Por lo que <em><u>present\u00f3<\/u><\/em> un <\/mark><mark style=\"background-color:#8df1d2\" class=\"has-inline-color\"><strong>amparo<\/strong> <\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">directo, <em><u>argumentando<\/u><\/em> que los <em><u>intereses y la pena eran<\/u><\/em><strong> <\/strong><\/mark><mark style=\"background-color:#8df1d2\" class=\"has-inline-color\"><strong>usurarios<\/strong> y <strong>explotativos<\/strong>.<\/mark><mark style=\"background-color:#ffffff\" class=\"has-inline-color\"> <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:#ffffff\" class=\"has-inline-color\">El <em><u>Tribunal<\/u><\/em> Colegiado <em><u>concedi\u00f3 el amparo<\/u><\/em> para <\/mark><mark style=\"background-color:#8df1d2\" class=\"has-inline-color\"><strong>REVISAR los intereses<\/strong>, pero <strong>NO<\/strong> <strong><u>la pena<\/u><\/strong>,<\/mark> por lo que interpuso un recurso de revisi\u00f3n.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#026096\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>ante lo 0, 0);color:#058f5c\" class=\"has-inline-color\"> <strong>analizar<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">las&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\"><strong>cl\u00e1usulas<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de un&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\"><strong>contrato de arrendamiento<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">para <em><u>DETECTAR<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\">&nbsp;<strong>explotaci\u00f3n<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">esto seg\u00fan el&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\"><strong>art. 21.3<\/strong>&nbsp;de la&nbsp;<strong>Convenci\u00f3n Americana sobre Derechos Humanos<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>cuando se advierta<\/u><\/em> un&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\"><strong>exceso<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">&nbsp;o&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\"><strong>desproporci\u00f3n<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">&nbsp;en las&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\"><strong>prestaciones<\/strong>&nbsp;y&nbsp;<strong>contraprestaciones <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">econ\u00f3micas de cualquier negocio&nbsp;que afecte la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#058f5c\" class=\"has-inline-color\">&nbsp;<strong>dignidad<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#af0751\" class=\"has-inline-color\">.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#310696\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, La&nbsp;<mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\"><strong>propiedad privada<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">est\u00e1 protegida contra la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\">&nbsp;<strong>usura<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\"><strong>explotaci\u00f3n<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">seg\u00fan el&nbsp;art\u00edculo en menci\u00f3n&nbsp;de la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\"><strong>Convenci\u00f3n Americana<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Por lo que, la&nbsp;<em><u>Primera Sala<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\"><strong> Distingue<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> ENTRE<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\"> <strong>usura y explotaci\u00f3n<\/strong>: <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">La<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\">&nbsp;<strong>usura<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">implica un&nbsp;<em><u>inter\u00e9s excesivo&nbsp;en un pr\u00e9stamo<\/u><\/em>, mientras que la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#d50971\" class=\"has-inline-color\">&nbsp;<strong>exceso<\/strong>&nbsp;o&nbsp;<strong>desproporci\u00f3n<\/strong>&nbsp;en
