autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" referrerpolicy=\"strict-origin-when-cross-origin\" allowfullscreen><\/iframe>\n<\/div><\/figure>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Este <strong>ANTECEDENTE<\/strong><\/p>\n\n\n\n<p>Surge despu\u00e9s de que, un hombre demand\u00f3 el <mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"><strong>reconocimiento de paternidad<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de su hija menor de edad, y el JUEZ familiar <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"><strong>orden\u00f3<\/strong> al <em><u>Registro Civil<\/u><\/em> <strong>emitir<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> una NUEVA<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"> <strong>acta de nacimiento<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">con el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"> <em><u>apellido del padre en <strong>primer luga<\/strong>r<\/u><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\">La <em><u>madre<\/u><\/em>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> al no impugnar la sentencia<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\">, <em><u>solicit\u00f3 cambiar el orden de los apellidos<\/u><\/em>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">pero el JUEZ<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"> <strong>neg\u00f3 la petici\u00f3n por considerar que hab\u00eda cosa juzgada<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">La madre promovi\u00f3 un juicio de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"> <strong>amparo<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">indirecto, y el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#620ab5\" class=\"has-inline-color\"><em><u>Juez de Distrito<\/u><\/em> <strong>concedi\u00f3 la protecci\u00f3n constitucional,<\/strong> <em><u>argumentando que la cosa juzgada es <strong>FLEXIBLE<\/strong> en casos de derechos al nombre y la identidad de menores<\/u><\/em><\/mark>. <\/p>\n\n\n\n<p>El padre interpuso un recurso de revisi\u00f3n ante la Primera Sala.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#17018c\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>ante lo anterior <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#840404\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, en casos sobre <mark style=\"background-color:#b7dbf2\" class=\"has-inline-color\"><strong>derechos al Nombre e Identidad de menores<\/strong>, las <em><u>Autoridades judiciales<\/u><\/em> DEBEN <em><u>asegurarse de que la cuesti\u00f3n planteada haya sido previamente analizada en una sentencia firme<\/u><\/em>, <strong><em><u>cumpliendo<\/u><\/em><\/strong><em><u> todas las formalidades del procedimiento<\/u><\/em> y <strong>garantizando<\/strong> el <em><u>derecho de participaci\u00f3n del menor<\/u><\/em>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#c20465\" class=\"has-inline-color\"> <strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#c20465\" class=\"has-inline-color\"> <strong>SCJN <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">es que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#c20465\" class=\"has-inline-color\">, <strong>la cosa juzgada<\/strong>&nbsp;<em><u>garantiza la seguridad jur\u00eddica y el acceso a la justicia<\/u><\/em>, <strong>resultando<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de un juicio con todas las formalidades cumplidas.
