<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"> <strong>juicio civil<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">para declarar la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"><strong>nulidad<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"> <strong>testamento<\/strong>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em>En primera instancia<\/em>,<em> se determin\u00f3<\/em> que el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"> <strong>notario NO especific\u00f3 c\u00f3mo identific\u00f3 a la testadora<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Sin embargo, en <em>segunda instancia, el tribunal <\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"><strong>revoc\u00f3<\/strong> <\/mark><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">esa decisi\u00f3n al considerar que, aunque el notario<\/mark><\/em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"> <strong>omiti\u00f3 <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em>detallar el m\u00e9todo de identificaci\u00f3n<\/em>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"> <strong>s\u00ed incluy\u00f3 datos personales suficientes<\/strong> <em>tales como nacionalidad, fecha de nacimiento, ocupaci\u00f3n, RFC, CURP, domicilio y nombres de los padres<\/em>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#460683\" class=\"has-inline-color\"> <strong>permit\u00edan identificarla adecuadamente.<\/strong><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#2a078b\" class=\"has-inline-color\"> <strong>Suprema Corte de Justicia <\/strong><\/mark>a trav\u00e9s del Tribunal <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#7c0303\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que el t\u00e9rmino <mark style=\"background-color:rgba(0, 0, 0, 0);color:#036843\" class=\"has-inline-color\"><strong>\u201cpersona identificable\u201d<\/strong> en el derecho de acceso a la informaci\u00f3n, <strong>NO equivale a acreditar la identidad del testador<\/strong> en un <strong>testamento p\u00fablico abierto.<\/strong><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La justificaci\u00f3n de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#220489\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, de la<strong> <\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"><strong>interpretaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de los art\u00edculos&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"><strong>1401, 1402 y 1403<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\">C\u00f3digo Civil <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en este caso de Nuevo Le\u00f3n se<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"> <strong>establece<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> que la IDENTIDAD del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"> <strong>Testado<\/strong><em><strong>r <\/strong><\/em><\/mark><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en un<\/mark><\/em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"><em> <strong>testamento<\/strong> p\u00fablico abierto<\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">DEBE<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"> <strong>acreditarse plenamente<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Esto puede hacerse mediante documentos con fotograf\u00eda o con testigos que lo conozcan. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">El <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\"><strong>concepto de &#8220;persona identificable&#8221;<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">usado en el derecho de acceso a la informaci\u00f3n<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\" class=\"has-inline-color\">, <strong>no es suficiente<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ya que <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a87303\"
