style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\">&nbsp;<strong>quejosa<\/strong>&nbsp;<em><u>IMPUGN\u00d3<\/u><\/em> la&nbsp;<strong>declaratoria de procedencia de extradici\u00f3n<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y present\u00f3 una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\">&nbsp;<strong>recusaci\u00f3n<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">contra la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\">&nbsp;<strong>juzgadora de Distrito<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">alegando un posible&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\"><strong>impedimento<\/strong>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">El&nbsp;<em>Tribunal Colegiado de Circuito<\/em>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\"><strong>desech\u00f3 el escrito<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">porque <em>no se incluy\u00f3 la declaraci\u00f3n<\/em>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\"><strong>&#8220;bajo protesta de decir verdad&#8221;<\/strong>, <em><u>requisito formal indispensable<\/u><\/em>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Ante esto, la parte quejosa <em><u>INTERPUSO<\/u><\/em> un&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\"><strong>recurso de reclamaci\u00f3n<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">argumentando que dicho requisito vulnera el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\">&nbsp;<strong>derecho de acceso a la justicia<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">La<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\">&nbsp;<strong>Primera Sala<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">atrajo el caso para analizar el recurso y resolver el problema de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#4e0395\" class=\"has-inline-color\">&nbsp;<strong>constitucionalidad<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#010890\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s de la Primera Sala <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#940505\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, <em><u>el art\u00edculo 59 de la Ley de Amparo<\/u><\/em>, que <mark style=\"background-color:#b4eb8b\" class=\"has-inline-color has-black-color\"><strong>EXIGE<\/strong> declarar&nbsp;<strong>&#8220;bajo protesta de decir verdad&#8221;<\/strong>&nbsp;en una&nbsp;<em><u>RECUSACI\u00d3N<\/u><\/em>,&nbsp;<strong>NO Viola<\/strong>&nbsp;el&nbsp;<strong>derecho de acceso a la justicia<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#b54e05\" class=\"has-inline-color\"> <strong>justificaci\u00f3n<\/strong><\/mark><strong> <\/strong>de la<mark style=\"background-color:rgba(0, 0, 0, 0);color:#300687\" class=\"has-inline-color\"> <strong>SCJN<\/strong><\/mark> es que, la protesta de decir verdad <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#078858\" class=\"has-inline-color\">EXIGIDA<\/mark><\/strong> en el <em><u> art. 59,de la Ley de Amparo<\/u> tiene fundamento en e<\/em>l art\u00edculo 130 Constitucional, que establece la <mark style=\"background-color:rgba(0, 0, 0, 0);color:#af4c05\" class=\"has-inline-color\"><strong>promesa de decir verdad<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Este requisito busca asegurar que las partes act\u00faen con <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#af4c05\" class=\"has-inline-color\"><strong>veracidad, <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">por lo que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#af4c05\" class=\"has-inline-color\"> <strong>no<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">es <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#af4c05\" class=\"has-inline-color\"><strong>excesivo ni injustificado<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ya que proviene de la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#af4c05\" class=\"has-inline-color\"><strong>Norma Suprema<\/strong>.<\/mark><\/p>\n\n\n\n<p>Y cumplir con la&nbsp;<mark style=\"background-color:rgba(0, 0, 0, 0);color:#a34603\" class=\"has-inline-color\"><strong>protesta de decir verdad<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">no es un exceso, sino una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#a34603\" class=\"has-inline-color\"><strong> medida<\/strong>&nbsp;<strong>proporcional<\/strong>&nbsp;<\/mark>que busca:<\/p>\n\n\n\n<ul>\n<li><mark style=\"background-color:#fecaa5\" class=\"has-inline-color\">Dar&nbsp;<strong>certeza<\/strong>&nbsp;a la autoridad sobre un posible&nbsp;<strong>impedimento<\/strong>, <\/mark>y <\/li>\n\n\n\n<li><mark style=\"background-color:#b1edd5\" class=\"has-inline-color\">Permitir que el&nbsp;<strong>juzgador recusado<\/strong>&nbsp;rinda informe. <\/mark><\/li>\n<\/ul>\n\n\n\n<p>As\u00ed se protege el <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"><strong>acceso a una justicia imparcial,<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><strong> <\/strong>por lo que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"> <strong>Eximir<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el <em><u>requisito<\/u><\/em> de la&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\"><strong>protesta de decir verdad<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>ENTORPECER\u00cdA<\/u><\/em> el proceso, al basarse en afirmaciones sin responsabilidad.
