has-black-color\">en una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#014e0a\" class=\"has-inline-color\"> <em><u>cirug\u00eda est\u00e9tica de afirmaci\u00f3n de g\u00e9nero<\/u><\/em>, <strong>alegando<\/strong> <em><u>FALTA de consentimiento informado<\/u><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Aunque <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#014e0a\" class=\"has-inline-color\"><strong>inicialmente se conden\u00f3 al m\u00e9dico<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en APELACI\u00d3N se le<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#014e0a\" class=\"has-inline-color\"> <em><u>absolvi\u00f3 por existir documentos v\u00e1lidos y conocimiento previo de los riesgos<\/u><\/em>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#014e0a\" class=\"has-inline-color\">La <strong>paciente<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> PROMOVI\u00d3 un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#014e0a\" class=\"has-inline-color\"> <strong>amparo<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">directo,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#014e0a\" class=\"has-inline-color\"> <em><u>cuestionando el est\u00e1ndar aplicado sobre el deber de informar.<\/u><\/em><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong>S<mark style=\"background-color:rgba(0, 0, 0, 0);color:#340685\" class=\"has-inline-color\">uprema Corte de Justicia<\/mark> <\/strong>ante lo anterior<strong> <mark style=\"background-color:rgba(0, 0, 0, 0);color:#780505\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que<strong>,<\/strong> en el <mark style=\"background-color:rgba(0, 0, 0, 0);color:#9c046b\" class=\"has-inline-color\"><strong>DEBER de informar<\/strong> en <em><u>cirug\u00edas de afirmaci\u00f3n de g\u00e9nero<\/u><\/em> <strong>requiere un est\u00e1ndar reforzado<\/strong> <em><u>por su v\u00ednculo con los derechos a la autonom\u00eda, identidad y salud.<\/u><\/em><\/mark><\/p>\n\n\n\n<p>Esto implica:<\/p>\n\n\n\n<ol start=\"1\">\n<li><mark style=\"background-color:#f1b1c1\" class=\"has-inline-color\">Un <strong>proceso comunicativo s\u00f3lido entre el personal m\u00e9dico<\/strong> y la persona <strong>paciente<\/strong>.<\/mark><\/li>\n\n\n\n<li><mark style=\"background-color:#a0d5f3\" class=\"has-inline-color has-black-color\">Mayor diligencia para <strong>explicar riesgos generales y espec\u00edficos<\/strong> seg\u00fan el caso.<\/mark><\/li>\n\n\n\n<li><mark style=\"background-color:#fee191\" class=\"has-inline-color\">Un umbral ampliado de informaci\u00f3n: DEBE ser <strong>suficiente, clara, accesible, veraz y adaptada a las caracter\u00edsticas y expectativas de cada persona<\/strong>.<\/mark><\/li>\n<\/ol>\n\n\n\n<p>.<\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">La <strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la <strong>SCJN<\/strong> es que, La<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>cirug\u00eda pl\u00e1stica est\u00e9tica<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">especialmente la de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>afirmaci\u00f3n de g\u00e9nero<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">implica factores que afectan l<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">a&nbsp;<strong>toma de decisiones<\/strong>, la&nbsp;<strong>relaci\u00f3n m\u00e9dico-paciente<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y los<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>incentivos m\u00e9dicos<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Por ello, se requiere un&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\"><strong>est\u00e1ndar reforzado<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que garantice que la persona est\u00e9<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>plenamente informada<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y que el personal m\u00e9dico respete su<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>autonom\u00eda<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">por encima de otros intereses.<\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">La<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>cirug\u00eda de afirmaci\u00f3n de g\u00e9nero<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">por su car\u00e1cter&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\"><strong>voluntario<\/strong>,&nbsp;<strong>identitario<\/strong>&nbsp;<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y rodeada de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#883901\" class=\"has-inline-color\">&nbsp;<strong>din\u00e1micas sociales<\/strong>, <\/mark><mark
