pagaron horas extras, lo cual fue<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#2f0359\" class=\"has-inline-color\"> <strong>desmentido parcialmente<\/strong> <\/mark><mark I, inciso d<\/u><\/em><strong>)<\/strong> de la <em><u>Ley Federal del Trabajo.<\/u><\/em><\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#031074\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s Tribunal Colegiado de Circuito, <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#7a0303\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, la<mark style=\"background-color:#ba83ed\" class=\"has-inline-color\"> <strong>multa<\/strong> de los <em><u>art\u00edculo 48 y 48 Bis<\/u><\/em> de la <em><u>Ley del Trabajo<\/u><\/em> <strong>NO se impone por no probar las pretensiones<\/strong>, sino por <em><u>realizar<\/u><\/em> <strong>actuaciones improcedentes<\/strong> con intenci\u00f3n de <strong>dilatar u obstaculizar<\/strong> el juicio.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la <strong>SCJN<\/strong> es que, el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>art. 48<\/strong> de la<em><u> <\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>Ley Federal del Trabajo<\/u><\/em> fue <em><u>reformado en 2012<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">para <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"><strong>limitar<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el <em><u>pago<\/u><\/em> de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>salarios ca\u00eddos<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>12 meses<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> en casos de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>despido injustificado<\/strong>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> como respuesta a<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>pr\u00e1cticas <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>prolongaban juicios laborales<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">para <em><u>generar pagos excesivos<\/u><\/em>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>AFECTANDO<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>empresas peque\u00f1as y medianas<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Adem\u00e1s, se incluyeron <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"><strong>sanciones<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">para quienes promovieran<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>actuaciones improcedentes<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">con el fin de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>dilatar u obstaculizar<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">el proceso, y medidas contra<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>servidores p\u00fablicos<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que incurrieran en<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#743203\" class=\"has-inline-color\"> <strong>omisiones o
