class=\"has-inline-color has-black-color\">a uno de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8e0361\" class=\"has-inline-color\"> <strong>segundo nivel<\/strong>, <\/mark><em><u><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">SIN justificaci\u00f3n ni continuidad en su tratamiento<\/mark><\/u><\/em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8e0361\" class=\"has-inline-color\">.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">El<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8e0361\" class=\"has-inline-color\"> <strong>JUEZ <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">concedi\u00f3 la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8e0361\" class=\"has-inline-color\"> <strong>suspensi\u00f3n<\/strong> para <strong>proteger<\/strong> su <strong>derecho a la salud<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Posteriormente, <em><u>interpuso<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8e0361\" class=\"has-inline-color\"> <strong>queja<\/strong>,<\/mark> solicitando que el tratamiento <em><u>continuara en el hospital especializado.<\/u><\/em><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#150277\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s Tribunal Colegiado de Circuito, <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#7e0202\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que,<mark style=\"background-color:#eefa6f\" class=\"has-inline-color\"> <em><u>PROCEDE<\/u><\/em> la <strong>suspensi\u00f3n de oficio y de plano<\/strong> CONTRA el <strong>cambio<\/strong> del enfermo<strong> de un hospital de tercer nivel a uno de segundo nivel<\/strong>, <em><u>poniendo<\/u><\/em> en <strong>riesgo real la vida o integridad<\/strong><\/mark> de este, seg\u00fan las pruebas y declaraciones presentadas.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong>justificaci\u00f3n <\/strong>de la <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#11027b\" class=\"has-inline-color\">SCJN<\/mark><\/strong> es que, seg\u00fan el <mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"><strong>art\u00edculo 126 <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>de la Ley de Amparo<\/u><\/em>, procede la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"><strong>suspensi\u00f3n de oficio y de plano<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ante <em><u>actos que impliquen<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"> <strong>riesgo de vida<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Aplicando el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"><strong>principio pro persona<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">esta <em><u>protecci\u00f3n se extiende cuando se niega<\/u><\/em> el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"> <strong>acceso a servicios de salud<\/strong>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> como en el caso del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"> <strong>traslado injustificado<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de un <em><u>paciente con enfermedad grave<\/u><\/em> de un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8c3c03\" class=\"has-inline-color\"> <strong>hospital de tercer nivel<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a uno de <em><u>menor capacidad<\/u><\/em>.
