Colegiados de Circuito <em><u>sostuvieron<\/u><\/em> <strong>criterios <mark style=\"background-color:#f78da7\" class=\"has-inline-color\">contradictorios<\/mark><\/strong> sobre sobre la <strong>boleta por infracci\u00f3n de tr\u00e1nsito<\/strong> en <strong>Ensenada, Baja California<\/strong> por <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\">conducir en estado de ebriedad<\/mark><\/strong>. <\/p>\n\n\n\n<p>Uno afirm\u00f3 que <strong>no es acto administrativo<\/strong>, el otro que s\u00ed, por lo que conforme al <strong>art. 117 de la Ley de Amparo<\/strong> DEBE <strong>correrse traslado<\/strong> al <strong>quejoso<\/strong> para que ejerza su <strong>derecho de defensa<\/strong>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La&nbsp;<strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#10019c\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark><\/strong>, a trav\u00e9s del&nbsp;Pleno Regional Materias Administrativa y Civil de la Regi\u00f3n Centro-Nte., <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8f0808\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, la <mark style=\"background-color:#cff096\" class=\"has-inline-color\"><strong>boleta de infracci\u00f3n<\/strong> es un <strong>acto materialmente administrativo<\/strong>, y por tanto se le DEBE <em><u>aplicar<\/u><\/em> los <strong>art\u00edculos 117 y 124 <\/strong>de la<strong> Ley de Amparo<\/strong>, por lo que <strong>SI se debe correr traslado<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"> <strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la <\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#340594\" class=\"has-inline-color\">SCJN<\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> es que, la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>boleta de infracci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">es una<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"> <strong>declaraci\u00f3n unilateral<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>emitida<\/u><\/em> por la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>administraci\u00f3n p\u00fablica<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">mediante un <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>elemento policial<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en ejercicio de su<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"> <strong>potestad administrativa<\/strong>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> con <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>efectos directos e inmediatos<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Debe cumplir con <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>fundamentaci\u00f3n y motivaci\u00f3n<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">expresando el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"> <strong>precepto legal aplicable<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y las <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>circunstancias espec\u00edficas<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Es un <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>acto discrecional<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">pues el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"><strong>Reglamento de Tr\u00e1nsito<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">OTORGA<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\" class=\"has-inline-color\"> <strong>libertad de apreciaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">al oficial, sin que ello implique <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#9e0553\"
