class=\"has-inline-color\"><strong>antig\u00fcedad gen\u00e9rica<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">alegando inicio laboral anterior al reconocido por la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"> <strong>empresa<\/strong>. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Ofrecieron como prueba la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"> <strong>inspecci\u00f3n del expediente personal<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"><strong>patronal ten\u00eda bajo su resguardo pero<\/strong> <strong>NO exhibi\u00f3<\/strong>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">La <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"><strong>Junta<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">tuvo por ciertas las <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"><strong>fechas de ingreso<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> y la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"><strong>demandada<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">promovi\u00f3<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#785903\" class=\"has-inline-color\"> <strong>amparo directo<\/strong><\/mark>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#16027d\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal Colegiado <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#6d0303\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, si el <mark style=\"background-color:#cde3f6\" class=\"has-inline-color\"><strong>trabajador<\/strong> DEMANDA <strong>antig\u00fcedad gen\u00e9rica<\/strong> y OFRECE como <em><u>prueba<\/u><\/em> la <strong>inspecci\u00f3n del expediente personal<\/strong>, pero el PATR\u00d3N <strong>NO lo Exhibe<\/strong>, entonces se <strong>presume cierta<\/strong> la <strong>fecha de Inicio Laboral<\/strong> indicada en la <strong>demanda<\/strong>, salvo <strong>prueba en contrario<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"><strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la <\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#010a7a\" class=\"has-inline-color\">SCJN<\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> es que de conformidad con el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>art\u00edculo 784<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la <em><u>Ley Federal del Trabajo<\/u><\/em>, el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>empleador<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">DEBE<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>acreditar<\/strong> la <strong>fecha de ingreso<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>antig\u00fcedad<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">incluyendo interrupciones, cuando pretenda demostrar que es menor a la reclamada. <\/mark><\/p>\n\n\n\n<p><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Adem\u00e1s, los <em><u>art\u00edculos 804 y 805<\/u><\/em> lo<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>obligan<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a <em><u>conservar y exhibir<\/u><\/em><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>contratos<\/strong>, <strong>recibos de n\u00f3mina<\/strong>, <strong>controles de asistencia,<\/strong> <strong>comprobantes de pago<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">participaci\u00f3n de utilidades, vacaciones, aguinaldo primas y dem\u00e1s documentos; de no hacerlo, se<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>presumen ciertos<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">los hechos de la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>demanda<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">salvo<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#1c6402\" class=\"has-inline-color\"> <strong>prueba en
