Por lo que, la <em><u>demandada contest\u00f3<\/u><\/em> y a su vez <em><u>formul\u00f3<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"><strong>reconvenci\u00f3n<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">En la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>sentencia<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>primera instancia<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se le<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>conden\u00f3<\/strong> al <strong>pago de dichas prestaciones<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y se le<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>absolvi\u00f3 <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"><strong> pago de la pena convencional y de los da\u00f1os y perjuicios<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">declar\u00e1ndose<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>improcedente<\/strong> la <strong>reconvenci\u00f3n<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Inconformes ambas partes interpusieron<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>apelaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">modific\u00e1ndose la sentencia. Durante la tramitaci\u00f3n la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"><strong>arrendataria<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">present\u00f3 escrito en el que<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>consign\u00f3 las llaves y el control de la entrada del inmueble<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">As\u00ed en la <em><u>sentencia<\/u><\/em> de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>segunda instancia<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se declar\u00f3 la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"> <strong>terminaci\u00f3n del contrato<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y se conden\u00f3 ordenando la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#805e01\" class=\"has-inline-color\"><strong>desocupaci\u00f3n y entrega del inmueble<\/strong><\/mark>. Ante ello, la parte actora promovi\u00f3 amparo directo.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#17026f\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark> <\/strong>a trav\u00e9s del Tribunal Colegiado de Circuito <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#8e0404\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, en <mark style=\"background-color:#97f0cf\" class=\"has-inline-color\"><strong>juicios de Arrendamiento<\/strong>, la <strong>consignaci\u00f3n de llaves<\/strong> del inmueble ante el <strong>juzgado<\/strong> <strong>NO LIBERA<\/strong> al <strong>demandado<\/strong> del <strong>pago de rentas<\/strong>, <strong>mantenimiento<\/strong> y <strong>servicios<\/strong>, salvo que <strong>acredite<\/strong> haber PROMOVIDO la <strong>notificaci\u00f3n al arrendador<\/strong> y su <strong>posesi\u00f3n del inmueble<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La <mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"><strong>justificaci\u00f3n<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><strong> <\/strong>de la <\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#20047e\" class=\"has-inline-color\">SCJN<\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> es que, conforme al<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>art\u00edculo 2487 del C\u00f3digo Civil para la CDMX<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que regula la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>t\u00e1cita reconducci\u00f3n<\/strong>: <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">si el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>arrendatario<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> sigue usando el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>inmueble<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> tras vencer el plazo, el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"><strong>arrendamiento<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">contin\u00faa por<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>tiempo indeterminado<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">debiendo pagar<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>renta<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">hasta la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"><strong>terminaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">solicitada por cualquiera de las partes. Si no hay<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>nuevo contrato<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">no hay<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>pr\u00f3rroga<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">y el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"><strong>arrendador<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">puede exigir<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>desocupaci\u00f3n<\/strong> y <strong>entrega<\/strong>.<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> En ese orden de ideas, la mera<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>entrega de llaves<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">mediante un escrito<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\">, <strong>no libera<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">autom\u00e1ticamente al<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>arrendatario del pago de rentas<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ya que no es posible conocer si el juego de llaves est\u00e1 completo o si corresponde al inmueble arrendado, m\u00e1s a\u00fan cuando el arrendador no conoce a\u00fan la consignaci\u00f3n, as\u00ed que la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <em><u>restituci\u00f3n de la posesi\u00f3n<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del Inmueble<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>no depende solo del arrendatario<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Para que sea v\u00e1lida, el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"><strong>juez debe aprobar la consignaci\u00f3n<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">despu\u00e9s de<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#024e17\" class=\"has-inline-color\"> <strong>notificar al arrendador<\/strong><\/mark> y <em><u>darle oportunidad de conocer y aceptar la entrega<\/u><\/em>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Estas <strong><mark style=\"background-color:#edb68f\" class=\"has-inline-color\">RESOLUCI\u00d3N<\/mark> <\/strong>est\u00e1 <strong>disponible<\/strong> para quien la <mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-vivid-red-color\"><strong>CONOZCA<\/strong> y la <strong>HAGA
