Ambas partes interpusieron <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#02754b\" class=\"has-inline-color\"><strong>apelaci\u00f3n<\/strong>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> <em><u>modific\u00e1ndose la sentencia<\/u><\/em>. Durante el recurso, la demandada entreg\u00f3<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#02754b\" class=\"has-inline-color\"> <strong>llaves<\/strong> y <strong>control del inmueble<\/strong>. En <strong>segunda instancia<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se declar\u00f3 la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#02754b\" class=\"has-inline-color\"> <strong>terminaci\u00f3n del contrato<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">ordenando la <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#02754b\" class=\"has-inline-color\"><strong>desocupaci\u00f3n y entrega del inmueble<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Ante ello, la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#02754b\" class=\"has-inline-color\"> <strong>actora promovi\u00f3 amparo directo<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#2302ac\" class=\"has-inline-color\"> <strong>Suprema Corte de Justicia<\/strong><\/mark><strong> <\/strong>a trav\u00e9s del Tribunal Colegiado de Circuito <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#960606\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, para acreditar <mark style=\"background-color:#f7eb92\" class=\"has-inline-color\"><strong>da\u00f1os y perjuicios<\/strong> en un <strong>inmueble arrendado<\/strong><em><u>, basta con demostrarlo mediante<\/u><\/em> una <strong>diligencia actuarial<\/strong>, para que el <strong>arrendatario<\/strong> deba <strong>repararlos<\/strong>. As\u00ed que, si existe un <strong>dep\u00f3sito<\/strong>, <em><u>DEBER\u00c1 APLICARSE<\/u><\/em> a los <strong>menoscabos ocasionados<\/strong>, cuya <strong>cuantificaci\u00f3n<\/strong> podr\u00e1 realizarse en <strong>ejecuci\u00f3n de sentencia<\/strong><\/mark>.<\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>SCJN<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> es que, en t\u00e9rminos del<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>art\u00edculo 285 del C\u00f3digo de Procedimientos Civiles para el DF<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>aplicable<\/u><\/em> en <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>CdMx<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">en <em><u>juicios de arrendamiento inmobiliario<\/u><\/em> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>SOLO debe probarse que se sufrieron<\/strong> <strong>da\u00f1os<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Su<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>cuantificaci\u00f3n<\/strong>, <strong>reparaciones<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> o <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>mejoras<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"><em><u>podr\u00e1n realizarse<\/u><\/em> en<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>ejecuci\u00f3n de sentencia<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Si los<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>da\u00f1os y perjuicios<\/strong> <\/mark><em><u><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se acreditan mediante una<\/mark><\/u><\/em><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>diligencia actuarial<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">que <em><u>refleje las condiciones del inmueble al momento de la devoluci\u00f3n<\/u><\/em>, NO es necesario detallar cada da\u00f1o, pues <em><u>basta<\/u><\/em> el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>acta del actuario judicial<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">As\u00ed, el<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>arrendatario<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">debe<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>repararlos<\/strong>,<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> y<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>si existe<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> un<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>dep\u00f3sito<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">se aplicar\u00e1 a los <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>menoscabos ocasionados<\/strong>. <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">Adem\u00e1s, si el arrendatario se oblig\u00f3 a devolver el bien en el mismo estado en que lo recibi\u00f3, el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>dep\u00f3sito<\/strong> <\/mark><strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">debe aplicarse primero<\/mark><\/strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">a la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>reparaci\u00f3n de da\u00f1os<\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\"> y luego devolver el <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>remanente<\/strong>, <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">lo que podr\u00e1 realizarse en<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"> <strong>ejecuci\u00f3n de sentencia<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">mediante <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#924106\" class=\"has-inline-color\"><strong>prueba pericial<\/strong>.<\/mark><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>Estas <strong><mark
