Un criterio exige que el <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\">propietario<\/mark><\/strong> sea quien <u>d\u00e9 el uso educativo<\/u>; el otro considera suficiente que el inmueble <strong>sea propiedad<\/strong> del solicitante y se <strong><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-orange-color\">imparta ense\u00f1anza autorizada<\/mark><\/strong>, sin importar qui\u00e9n la realice.<\/em><\/p>\n\n\n\n<p>.<\/p>\n\n\n\n<p>La&nbsp;<strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#020481\" class=\"has-inline-color\">Suprema Corte de Justicia<\/mark><\/strong>, ante lo anterior <strong><mark style=\"background-color:rgba(0, 0, 0, 0);color:#680202\" class=\"has-inline-color\">DETERMIN\u00d3<\/mark> <\/strong>que, <mark style=\"background-color:#fdef56\" class=\"has-inline-color\">basta con que la persona sea <strong>propietaria del inmueble<\/strong> DESTINADO a <strong>planteles escolares<\/strong> con <em><u>ense\u00f1anza obligatoria o universitaria<\/u><\/em> para <strong>aplicar<\/strong> la <strong>tarifa especial del impuesto predial<\/strong>, <strong>aunque otro preste el servicio educativo<\/strong><\/mark><\/p>\n\n\n\n<p><strong>.<\/strong><\/p>\n\n\n\n<p>La<mark style=\"background-color:rgba(0, 0, 0, 0);color:#850157\" class=\"has-inline-color\"> <strong>justificaci\u00f3n <\/strong><\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">de la <strong>SCJN<\/strong> es que, la<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#850157\" class=\"has-inline-color\"> <strong>interpretaci\u00f3n teleol\u00f3gica<\/strong> <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-black-color\">del art\u00edculo demuestra que el requisito de que el inmueble<\/mark><mark style=\"background-color:rgba(0, 0, 0, 0);color:#850157\" class=\"has-inline-color\"> <strong>\u201csea propio\u201d<\/strong> NO EXIGE <\/mark><mark style=\"background-color:rgba(0, 0, 0, 0)\"
